EQ Bank Referral Program Terms and Conditions

This document sets out the terms and conditions (the “Terms”) applicable to the EQ Bank Referral Program (the “Program”). Capitalized terms not defined in these Terms shall have the meanings given to them in the EQ Bank Personal Account Agreement. All monetary amounts are in Canadian Dollars.

General
The Program is available on an ongoing basis, subject to any modification or termination of the Program by us. The Program is available to current EQ Bank customers who receive an offer from EQ Bank to participate in the Program (each a “Referrer”). This offer may be communicated via Online or Mobile Banking, or other forms of Electronic Communication undertaken by us from time to time. The offer will include a unique code or link to share with Friends and Family of the Referrer (a “Referral Link”). Individuals who open an EQ Bank Personal Account (Personal Account) pursuant to the Program are also subject to these Terms. Payment under the Program cannot be combined with any other offer except as expressly permitted by us.
For the purposes of these Terms, “Friends and Family” includes the known friends and family members with whom the Referrer has a close personal or family relationship and who have confirmed with the Referrer that they would like to receive communications about the Program. Friend and Family also includes business contacts of the Referrer who have communicated to the Referrer that they would like to receive communications about the Program. The Referrer represents and warrants to EQ Bank that all persons to whom they provide a Referral Link (“Referees”) are Friends and Family, as defined in these Terms.
Referral Bonus Conditions
1. A Referral Bonus will be paid for referrals that result in a New Client. A “New Client” means a Referee who:
  1. successfully opens a Personal Account, using a valid Referral Link; and
  2. funds their account (minimum $100) within 30 calendar days of account activation.
  For clarity, a New Client does not include any person who had a Personal Account prior to the referral. For the purposes of this Program, a person who signs up for a Personal Account via a link to join an EQ Bank Joint Account will not be considered a “New Client”.
2. The Referral Bonus will be calculated as follows:
  1. Bonus paid to Referrers
    1. $20 for the first three (3) New Clients
    2. $30 for the fourth (4^th) to seventh (7^th) New Clients
    3. $40 for the eighth (8^th) to fifteenth (15^th) New Clients
    4. No Bonus is paid for New Clients sixteen (16) and beyond
    5. Limit of $500 per Referrer
  2. Bonus paid to Referees
    1. $20 when they become a New Client
3. The Referral Bonus will be credited to the Referrer’s Personal Account and to the New Client’s Personal Account following the New Client satisfying section 2a. of these Terms.
Termination, Suspension or Modification
Unless otherwise stated, these Terms shall take precedence over any other materials promoting the Program. We reserve the right, without prior notice, to terminate, suspend or modify the Referral Program or any part of it. This includes suspending, disqualifying, limiting, or revoking access to the Program for any individual we find or believe to be manipulating or otherwise abusing the process, fairness or integrity of the Program. Referral Bonuses paid through fraudulent activities or activities which violate these Terms will be null and void and repayment may be required by EQ Bank.
Canada’s Anti-Spam Legislation (CASL)
The Referrer acknowledges that they are subject to Canada’s Anti-Spam Legislation (CASL) and agrees that they will only send one email or text message to each Referee relating to the Referral Program. The Referrer is responsible for familiarizing themselves with their obligations under CASL and conducting themselves accordingly.
Taxes
The Referrer acknowledges that they are responsible for any obligations relating to tax reporting that arise from payments made to them under the Program.
Protection of Personal Information
By participating in the Program, each Referrer and Referee consents to the collection, use, disclosure, and retention of their personal information for the purposes of administering the Program and Referral Bonus fulfillment. It is further acknowledged that the Referrer will have access to the status of any referral, including the making of any minimum deposit by the Referee, and the Referrer agrees to keep information relating to the status of a referral confidential.

Acceptance
By sharing a Referral Link, the Referrer confirms they have read and understood these Terms and agrees to be bound by them. By opening a Personal Account using a Referral Link, the Referee confirms they have read and understood these Terms and agrees to be bound by them. Any notice provided by us with respect to these Terms will be deemed provided on the day it is posted on our website.
Governing Law
These Terms and the Program shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
Language of Terms
For Québec residents only: You acknowledge and agree that you have first been presented with and have examined the French version of these Terms, and that you then have expressly requested that these Terms, and all related documents including notices, be drawn up in the English language and that you wish to and agree to be bound by the English version of these Terms. Vous reconnaissez et convenez que la version française de les présentes modalités vous a d'abord été présentée et que vous les avez examinées, et que vous avez ensuite expressément demandé que les présentes modalités et tous les documents connexes, y compris les avis, soient rédigés en anglais et que vous souhaitez être lié par la version anglaise des présentes et que vous acceptez de l'être.
